Pahayag ni Atty Jaqueline Ann de Guia, CHR spokesperson, ukol sa pagpapahubad sa isang quarantine violator sa Manila

Lubos na nababahala ang Komisyon sa mga Karapatang Pantao (CHR) sa pagpapahubad ng isang barangay kagawad sa isang quarantine violator na nahuli at pagpopost pa ng mga larawan ng nasabing pangyayari sa social media.

Mariing paalala ng Komisyon na hindi nasususpinde ang karapatang pantao kahit may umiiral na national health emergency.

Batid natin na ang mga paglabag ay dapat mapanagot. Pero ang anumang pagpapataw ng parusa na nagsasawalang bahala sa dignidad at karapatan ng sinuman ay maituturing na cruel, inhuman, at degrading treatment/punishment at isang paglabag sa Republic Act No. 9745 o Anti-Torture Act.

Marami tayong magagandang halimbawa mula sa ibang local governments na mas makatao ang kaakibat na aksyon sa paglabag, tulad nalang ng pagpapanood ng videos sa tunay na epekto ng Covid-19, nang lalong maintindihan ng mga mamamayan ang kahalagahan ng health safety protocols na umiiral, tulad ng pagsusuot ng face mask, physical distancing, quarantine, at iba pa. Ang kakulangan sa kaalaman sa epekto ng pandemiya ay isa rin sa mga posibleng dahilan sa paglabag.

Pinapaalalahan namin ang mga bawat opisyal sa pamahalaan—sa national at local governments—na sila ay may tungkulin itaguyod at protektahan ang karapatan at dignidad ng lahat. Ito ay kaakibat na obligasyon ng kanilang posisyon at tungkulin sa bayan at mga mamamayan.
