Statement of CHR Spokesperson, Atty. Jacqueline Ann de Guia, lauding the issuance of the executive order that institutionalizes the access to protection services of refugees

The Commission on Human Rights (CHR) lauds the national government’s commitment to assist and protect those seeking asylum in the country through the issuance of Executive Order 163, s. 2022 (EO 163). Entitled “Institutionalizing Access to Protection Services for Refugees, Stateless Persons, and Asylum Seekers,” the executive order guarantees the protection of the rights to security, liberty, and mobility of refugees.

As the country’s first policy on refugees that provide benefits beyond entry to the Philippines, EO 163 is considered a milestone document. It institutionalizes the Inter-Agency Committee on the Protection of Refugees, Stateless Persons, and Asylum Seekers, which is chaired by the Secretary of the Department of Justice and vice-chaired by the Secretary of the Department of Social Welfare and Development.

It is commendable that the executive order seeks to employ a convergence approach to be able to provide the holistic needs of refugees. These include the provision and access to government programs, such as health services, social protection, education, legal assistance, and gainful employment. In the wake of the Russian invasion of Ukraine, EO 163 is a timely and relevant issuance that demonstrates our country’s compassion towards those seeking refuge during times of emergency.

The Philippines has always been among the first nations to open its doors to those seeking safe haven from a place of conflict. Prior to EO 163, the country has been consistently fulfilling its obligations under the 1951 Refugee Convention—an international document that protects the rights of refugees.

As part of the international community, we have a responsibility to help citizens from countries that are experiencing humanitarian crises. In the same manner, we expect other countries to ensure the rights of Filipino migrant workers residing in their respective territories. Regardless of nationality, everyone is entitled to equal recognition of dignity and rights, especially displaced individuals who are experiencing compounding vulnerability.
