Statement of the Commission on Human Rights on the court decision on the shooting of Jemboy by police officers

The Commission on Human Rights (CHR) notes with concern the recent decision of the Navotas City Regional Trial Court (RTC) Branch 286 on the shooting of 17-year-old Jehrode “Jemboy” Baltazar. The penalties, which resulted to the release of five involved police officers and only one officer sentenced to four-year imprisonment, raises questions on the administration of justice in cases of deaths involving law enforcers.

While we recognize the court’s acknowledgment of the wrongful actions of the five police officers, we equally note the Baltazar family’s sentiment that the penalties do not adequately reflect the severity of the crime committed. Considering the irreversible loss of life of the young boy and the enduring sorrow suffered by his family, the verdict provided insufficient justice for the victim and his family.

CHR has provided financial and legal assistance to the family of Jemboy in recognition of the human rights violation committed. As a national human rights institution, the Commission stresses the importance of meeting the full standards of accountability that would ensure deterrence and long-term reforms to genuinely address all forms of police abuse and violence. Inadequate justice is tantamount to undervaluing the life of individuals like Jemboy. Further, it is reflective of the problem of impunity and can convey the troubling message that erring law enforcement officers can easily evade the force of justice.

The Commission expresses its support to the Department of Justice in its effort to pursue stronger convictions for the police officers involved. We also call upon all relevant authorities to review this case carefully in pursuit of the principles of justice and human rights.

CHR reiterates our steadfast call for sustained reforms within the Philippine National Police, including improving training and promoting transparency and accountability, to prevent another death during police operations. No more young boy should be deprived of life again, especially in the hands of those duty-bound to protect the right to life.
