The Human Rights Advisory CHR (VI) No. A2026-010 sets out the Commission on Human Rights’ position on the proposed international convention on the prevention and punishment of crimes against humanity. The CHR supports the establishment of a dedicated international convention, noting that it would strengthen the international human rights framework by addressing legal and institutional gaps, promoting accountability, and enhancing cooperation among States in preventing, investigating, prosecuting, and punishing crimes against humanity.

The Commission also supports the Philippine Government’s position on the Draft Articles, particularly in view of the country’s existing legal framework under Republic Act No. 9851, which already criminalizes genocide, war crimes, and other crimes against humanity. The Government has expressed support for stronger international cooperation while emphasizing respect for State sovereignty.

On persecution, the CHR agrees with the Government’s position on recognizing gender dimensions and supports the inclusion of sexual orientation as a ground for persecution. The Commission further recommends that age be explicitly included as a ground, emphasizing that children and older persons may be particularly vulnerable to rights violations because of their age.

The CHR also recommends a Whole-of-Government approach to raise awareness and build the capacity of stakeholders on the proposed convention. It commits to continuing its engagement with the Government, monitoring developments and the implementation of RA 9851, and promoting a human rights-based approach with accountability at the center of efforts to address crimes against humanity.
