Pahayag ng Commission on Human Rights ukol sa ordinansa sa Kalookan na nagpapataw ng parusa sa mga di-bakunado na magsisimba

Lubos na nababahala ang Commission on Human Rights (CHR) sa aming natanggap na ulat ukol sa ordinansa ng pamahalaan ng bayan ng Kalookan na nagbabanta ng parusa sa mga di-bakunado na magsisimba o mananampalataya. Nakapaskil diumano ang naturang ordinansa sa mga gate ng simbahan. Muling ipinapaalala ng CHR na walang batas ukol sa mandatory vaccination. Hindi sang-ayon sa batas na parusahan ang mga di-bakunado at pagkaitan ng kanilang karapatang magsimba at manampalataya.

Ayon sa Seksyon 5 ng Saligang Batas, “The free exercise and enjoyment of religious profession and worship, without discrimination or preference, shall forever be allowed.” Nangangahulugan ito na ang pagparusa sa mga di-bakunadong nagsisimba at/o nanampalataya ay labag sa Saligang Batas. Samakatuwid, nananatili ang karapatan nilang manampalataya at maging ang iba pa nilang mga batayang karapatan.

Inuulit namin na suportado ng Komisyon ang malawakang pagbabakuna para makamit ang herd immunity na mahalaga para masugpo ang Covid-19. Subalit sa halip na magpataw ng parusa at/o magbanta laban sa mga di-bakunado, patuloy naming hinihikayat ang pagpapatupad ng mga positibong paraan para tugunan ang vaccine hesitancy. Kabilang dito ang masigasig na information at education campaign at pagbibigay ng insentibo sa mga magpapabakuna.

Maging sa panahon ng krisis, anumang polisiya o ordinansa ay dapat sumusunod sa mga makataong pamantayan na nakasaad sa Siracusa Principles: dapat nakasaad ito sa national law; hindi magdudulot ng diskriminasyon; hindi mapanghimasok; at, angkop, nauukol, at wasto batay sa layunin nito. Responsibilidad rin ng gobyerno na bigyang-katwiran at ipaliwanag ang anumang restriksyon sa mga karapatan at kalayaan ng mamamayan. Hinihikayat ng Komisyon ang pamunuan ng Kalookan na makipag-dayalogo sa mga alagad ng simbahan upang siguruhin ang lubos na paggalang sa karapatan at dignidad ng mga mananampalataya ayon sa mga nabanggit na prinsipyo. ###
