Statement of the Commission on Human Rights on PDEA’s public disclosure of a drug suspect’s HIV status
A recent buy-bust operation by the Philippine Drug Enforcement Agency (PDEA) led to the apprehension of 11 drug suspects. During a press briefing, PDEA disclosed that one of them is HIV-positive.
The Commission on Human Rights notes that such action violates Republic Act No. 8504 or the Philippines AIDS Prevention and Control Act meant to guarantee the privacy and prevent the discrimination, in all forms and subtleties, against persons living with HIV/AIDS (PLHIVs).
As such, we echo our support to initiatives meant to curb the problem. But we also continue to stress that it must be done mindful of the rule of law and should avoid unnecessary victimization. Having HIV/AIDS does not diminish a person’s humanity and so they should also be accorded with respect and dignity like all others. But what this operation proves, on a more positive note, is that operations against illegal drugs can be carried out without the loss of lives.
At the same time, this incident is also a reminder to the media to be more discerning in covering stories involving the vulnerable and marginalized to avoid perpetuating stigma and negative bias. The media is in a powerful position to shape worldviews. The Commission hopes that they would use this status to promote and protect human rights for all
As we commemorate the World AIDS Day, may we all work towards a more sensitive and caring society that strives to end the spread of HIV/AIDS and the stigma against PLHIVs in all forms and channels. Let us collectively work on addressing this social problem as one humanity mindful of the dignity of all. ■
