Statement of the Commission on Human Rights on the proliferation of fake identification cards for persons with disabilities

The Commission on Human Rights (CHR) expresses its grave concern over reports of the alleged proliferation of fake identification cards (IDs) for persons with disabilities.

Under Republic Act No. 7277, or the Magna Carta for Disabled Persons, as amended by Republic Act No. 10754, persons with disabilities are entitled to a 20 percent discount and exemption from value-added tax (VAT) on certain goods and services through the use of a valid identification cards for persons with disabilities.

The proliferation of fake identification cards for persons with disabilities is a serious violation of the law and an affront to the dignity and rights of persons with disabilities. Fraudulent practices of this nature undermine the integrity of these privileges and trivialize the legitimate struggles and daily challenges faced by persons with disabilities. These benefits are essential to improving their quality of life and fostering inclusivity in society.

The Department of Social Welfare and Development (DSWD) has rightly taken steps to address this issue by supporting the development of a unified ID system. This system is intended to enhance transparency and accountability through real-time ID verification, ensuring that benefits reach only those who genuinely qualify.

Similarly, the Bureau of Internal Revenue (BIR) has initiated a national crackdown on the sale and use of fake identification cards for persons with disabilities. This measure aims to prevent revenue losses due to fraudulent tax evasion schemes and protect the integrity of public services.

We commend and support these initiatives. They are crucial in safeguarding the benefits and privileges accorded to persons with disabilities while ensuring that resources are allocated to those who genuinely need them.

As the country’s national human rights institution, CHR remains steadfast in advocating for the protection of persons with disabilities against all forms of exploitation and discrimination. We call on all sectors of society, including businesses, organizations, and the general public, to actively combat fraudulent activities. Report any instances of fake identification cards for persons with disabilities or related schemes to the National Council on Disability Affairs (NCDA) at council@ncda.gov.ph, the Persons with Disability Affairs Office (PDAO), or appropriate law enforcement agencies. ###
