Ang Komisyon sa mga Karapatang Pantao (CHR) ay matagal nang kumikilios para matigil ang karahasan laban sa mga kababaihan. Matagal nang mariing tinututulan ng Komisyon ang anumang uri ng victim blaming at mga kaugaliang nagbabalewala at nagsasantabi sa karahasan laban sa kababaihan. Matagal na ring kinokondena ng CHR ang karahasan, lalo na kung ito ay gawa mismo ng mga kawani at opisyal ng gobyerno, at lalo’t higit kung gawa ito ng mga naatasan ng batas na tumugon sa karahasan at magbigay-hustisya sa mga biktima.

Lubhang nakababahala ang paglaganap ng victim blaming sa panahong ito. Dahil sa post na ito, nagkaroon ng mahabang diskusyon sa social media kung saan lumabas ang napakaraming pambabastos, victim blaming, at misogynistic remarks. Maraming “hija,” di lamang si Frankie Pangilinan, ang naging target ng pambabastos. Hindi lamang komentaryo tungkol sa pananamit ang kanilang natanggap, kundi pati banta ng panggagahasa. Dito makikita kung gaano kalaganap ang gender-based violence sa social media. Marami tayong batas na tumutugon sa mga karahasang ito, ngunit madalas ay hindi maganda ang implimentasyon ng mga ito.

Statement of Commission Karen S. Gomez-Dumpit on Online Misogyny and Violence Against Women

The Commission on Human Rights (CHR) has long been working to end violence against women. The Commission is opposed to any form of victim blaming and any attitude that tends to disregard or trivialize violence against women. We have long condemned violence, especially those perpetuated by public officials and employees, and most especially those committed by officers who are tasked to respond to violence and to serve justice.

We are deeply concerned about the prevalence of victim blaming in these times. It is even more bothersome that personalities and individuals who think that they can dictate how women should act, dress, or present themselves seem to be proud of this. This is despite the fact that we have many laws that seek to prevent any form of discrimination or violence against women, whether online or offline. The continued posting of misogynistic comments and remarks, even if they transgress our laws, seems to evince lack of concern and action on the part of government, especially among the police and cybercrime units, to address this concern.

The social media post of a police station that seems to impose upon women how they should dress to avoid rape is unacceptable. This is victim blaming. This is wrong because rape happens because there are rapists. It is even more deplorable that such remark came from officers who are supposed to protect women against violence. How do we expect women who are victims of rape and other forms of gender-based violence to report if the police officers think and behave this way?

This post triggered a long discussion on social media where misogynistic remarks and victim blaming surfaced. Many “hijas,” not just Frankie Pangilinan, became targets of comments that not only imposed how they should dress, but also of lewd remarks and threats of rape. This shows how prevalent gender-based violence is on social media. While we have laws to address such violence, these are often not implemented well.

As the Gender Ombud, the Commission reminds everyone that posting remarks that promote misogyny, victim blaming, and other forms of violence against women is prohibited by law. These are not protected speech covered by freedom of expression. We also remind our law enforcement agencies, especially their cybercrime units, to respond to these incidences of violence on social media. This is part of their duty to prevent violence against women.

The Commission also appeals to the cybercrime units of the PNP and NBI to address threats of rape and other forms of violence. Social media pages that promote violence against women need to be taken down. Women have the right to be free from any form of violence, online or offline. The State must ensure that they are protected from violence and their complaints addressed. The lack of action and silence among law enforcement agencies about an unacceptable post that originated from their ranks and to violence on social media emboldens perpetrators. This endangers the life, safety, and well-being of women.

The Commission is one with the government in ensuring the safety of women against violence. We are ready to cooperate with the different government agencies to address all forms of violence against women. We urge everyone to utilize the Commission’s reporting portal for gender-based violence (https://www.gbvcovid.report/). Reporting is not only an essential part of our collective goal to fight and eliminate violence against women, it may well be the last lifeline of a victim.
