The Commission on Human Rights (CHR) takes note of the report of the Human Rights Watch (HRW) on the state of human rights in the Philippines, describing a “deepened” human rights crisis in 2018. CHR recognises the independence of HRW in coming up with such assessment. The Commission on Human Rights (CHR-7) strongly condemns the ambush-killing last night of Atty. Mary Ann Castro, former Assistant City Prosecutor of Cebu City. We call on our law enforcement to intensify its criminal investigation to facilitate the immediate identification and prosecution of the perpetrators, to determine the motive of the crime, and give justice to the victim and her family. We assure the public that the CHR will likewise look into this case and coordinate with our law enforcement in all aspects of the investigation as all victims of human rights abuses deserve unqualified justice.
Being part of the civil service—may it be as an officer or employee—directs freedom of expression to be exercised with public interest in mind. The Constitution is clear that “[p]ublic officers and employees must, at all times, be accountable to the people, serve them with utmost responsibility, integrity, loyalty, and efficiency, act with patriotism and justice, and lead modest lives.” This standard is reiterated in RA 6713 or the Code of Conduct and Ethical Standards of Public Officials and Employees. The Commission on Human Rights welcomes the move of the Department of Education (DepEd) to issue a directive that ensures compliance of all its regional offices to the Data Privacy Act following the profiling done by police on members of the Alliance of Concerned Teachers (ACT). The tagging of teachers also calls for condemnation from DepEd to reassure and show support to the ACT members. The right to privacy is a fundamental human right. A number of human rights documents, including the Universal Declaration of Human Rights, the 1987 Constitution, and the Data Privacy Act among others, establish the nature of this freedom. The Commission on Human Rights lauds the National Privacy Commission (NPC) for stressing this view, in light of the reported profiling of members of the Alliance of Concerned Teachers. Human rights go beyond issues concerning alleged cases of extrajudicial killings. These can also pertain to other liberties, such as right to food; right to education; right to social security; right to free speech; right to privacy; right to a healthy environment; and right to due process among others—areas covered by other human rights organisations. Criticising the government for its gaps in protecting and promoting the human rights does not make human groups enemies of the state. The Commission on Human Rights commends the passage of the Philippine HIV and AIDS Policy Act as a response to the growing number of cases of HIV and AIDS among the population in the country. This advances Filipinos’ right to health, especially people living with HIV and AIDS, in line with the principles of equality and non-discrimination embodied under Article XIII, Section 11 of the 1987 Constitution. We look forward to the active engagement of all government agencies, civil society organisations, and the public at large, in realising effective preventive measures, better healthcare, and in breaking the stigma for people living with HIV and AIDS.
The Commission raises concern once more on the growing trend of tagging vocal groups or individuals as “leftist” or “communist” with the National Union of Journalists of the Philippines as the latest organization to be labeled as such. This fresh attack on media imperils the state of press freedom and leads to the weakening of democracy. Torture and kidnapping are prohibited acts under our laws. As crimes, these are grave human rights violations that should not be taken lightly or be used as a joke, especially if used to challenge the mandate of a constitutionally-mandated body, such as the Commission on Audit. Our state auditors perform crucial functions in ensuring that government funds are well-spent to the benefit of every Filipino. Dialogue and cooperation are better routes in improving the way government bodies deliver services to the people, rather than publicly discrediting functions which may cast doubt on how an agency performs it duty. ###
As part of their sworn duty to serve and protect, the police must acknowledge and recognize that the mere act of profiling already prejudices and discriminates against the members of the concerned groups, which is a blatant violation of the basic right to equal protection of the law. We also reiterate that such move infringes on the rights to privacy and association. Reports of alleged profiling of members of the Alliance of Concerned Teachers (ACT) are alarming as it violates rights to privacy and association, which are guaranteed freedoms in the Constitution among others. Should there be clear grounds against ACT and its members, then the police should be transparent in applying the law and equally ensure that due process is observed. Clandestine operations may lead to a number of abuses as it is easier to deny accountability for any action. The Commission on Human Rights recognises all the ill effects of illegal drugs to individuals and communities. As such, even from the start, we have expressed qualified support to the government campaign against illegal drugs and its intent to provide a better life to all Filipinos. The Commission on Human Rights urges the government to be circumspect in its pronouncements, especially those that may undermine government efforts to protect the welfare of Filipino workers overseas. Filipino domestic workers, especially women, face a number of challenges in some receiving countries. The current administration is fully aware of this condition when, in early 2018, the government even prompted a deployment ban in Kuwait following numerous cases of disappearance, death, and abuses of Filipino workers. The Commission on Human Rights strongly condemns the bombing at Cotabato City, which left two civilians dead and 37 others injured. We urge our security forces to act with urgency in making perpetrators accountable, especially that martial law is still in effect in Mindanao.
