児童扶養違反者を罰する法案を支持する人権委員会の声明

The Commission on Human Rights (CHR) strongly supports the passage of House Bill (HB) 8987, also known as An Act Ensuring Child Support and Penalizing Parental Refusal or Neglect Thereof. The proposed measure seeks to penalize the parent who fails to provide essential support for their children’s education, food, clothing, and other basic needs. Article XV, Section 3(2) of the 1987 Constitution mandates that “the State shall defend the right of children to assistance, including proper care and nutrition, and special protection from all forms of neglect, abuse, cruelty, exploitation, and other conditions prejudicial to their development.” The CHR affirms that parents have a fundamental responsibility to ensure the welfare […]

The Commission on Human Rights (CHR) urges for the swift passage of House Bill No. 10159, or the Magna Carta of Children Bill. During the first House Committee hearing headed by Rep. Angelica Natasha Co of the Committee on the Welfare of Children, the CHR took part in the discussions through Commissioner Beda A. Epres as the Focal for Child Rights to highlight its role in the protection and promotion of all Filipino children. Once HB 10159 is passed into law, the […]

⚠️ Trigger warning: Murder, rape, killings, assault ⚠️ The Commission on Human Rights (CHR) strongly deplores the series of separate incidences of violence committed against young women in Cebu City, Negros Oriental, and Naga City. The first case involves the gruesome murder of a 19-year-old in Cebu City who was later identified as Rhea Mae Tocmo, a resident of Panabo, Davao del Norte. On 17 July 2023, the victim was found dead inside a box secured with a packaging tape. Based on the initial reports of the local police, the young woman was possibly tortured. Further probe and medical examination are still being done to determine the motive of the […]

The Commission on Human Rights (CHR) is alarmed with reports that hazing was allegedly committed by the fraternity president of Magic 5 with a member of the Alpha Kappa Rho International Fraternity and the president of SPB fraternity against a minor that purportedly resulted in the victim’s hospitalization. Based on the preliminary investigation report of the Quezon City Police District (QCPD), the victim passed out due to unbearable pain and physical injuries. The victim was reportedly a member of the Scout Royale Brotherhood Nu-Theta Chapter Fraternity and transferred to Magic 5, which insulted his former “brothers.” As part of their fraternity rules, he was allegedly taken to San Roque in […]

人権委員会は、ケソン市での未成年者への性的虐待と、ダバオ・デル・ノルテ州タグム市での少女2人の強姦と殺害を非難する声明を発表した。

The Commission on Human Rights expresses grave concern over two separate incidents of sexual abuse against minors in Quezon City and the reported abduction, rape and killing of two girls in unrelated cases in Tagum City, Davao del Norte. On 30 April 2023, in Brgy. San Bartolome, a man allegedly approached a 14-year-old girl in front of a sari-sari store and proceeded to molest her. The victim told of the attack to her father, who then sought assistance from the Quezon City police. On the same day in Quezon City, a complainant from Brgy. Matandang Balara discovered that her hired house helper had been sexually abusing an eight-year-old girl and […]
学校における身体的いじめを容認する発言に関する人権委員会の声明

The Commission on Human Rights (CHR) acknowledges the initiative of the Senate of the Philippines in looking into the government’s anti-bullying programmes and how the State can further improve the protection of the rights and welfare of children with the review of Republic Act No. 10627 or the Anti-Bullying Act. As the country’s independent national human rights institution and Ombud for Children , we continue to stress that bullying is not a simple issue that only the child and their family have to face. School officials, as well as the community at large, need to similarly take part in preventing, if not totally eliminating, instances of bullying and addressing its […]

Statement of the Commission on Human Rights welcoming the DSWD-PAO agreement to pursue legal remedies against fathers who neglect child support

Child-rearing is a full-time job, all the more for single mothers who need to earn a living in order to support their families. This already demanding responsibility, coupled with the challenges of inflation and job security, entails support in order to ensure that children grow in a nurturing environment conducive to the development of their full potential. As such, the Commission on Human Rights (CHR) welcomes the collaboration of the Department of Social Welfare and Development (DSWD) and the Public Attorneys Office (PAO) to help children and their mothers receive support from estranged fathers. Through a signed memorandum of agreement, the two agencies will file cases—on behalf of wives, partners, […]

BAGUIO CITY — The regional office of the Commission on Human Rights (CHR) in the Cordillera Administrative Region (CAR) condemned on Tuesday, 6 September, the alleged child abuse and corporal punishment experienced by two elementary students in Kalinga. A video circulating online shows a few students in front of the class trying to solve mathematical problems on the board. Two of the students seem to be struggling in the exercise. Appearing frustrated, the teacher went behind the students and forcefully hit the students’ backs and pinched their ears. “Abuse of and violence against children learners should stop and never be tolerated as forms of teaching and discipline in schools,” Atty […]
Statement of CHR Executive Director, Atty Jacqueline Ann de Guia, on the Department of Education’s reiteration of its Gender-Responsive Basic Education Policy

The Department of Education (DepEd) stresses through several policy issuances that the center of the Philippine basic education is the learner, particularly the child. The recent adoption of the Rights-Based Education (RBE) Framework for Philippine Basic Education underscores the duty of schools, learning centers, and offices to respect, protect, fulfill, and actively promote the full range of rights of children. The RBE Framework clarifies that the right to education goes beyond the discussion of access, but also pertains to the quality of education received by the child learners and their well-being in their learning environments. In this regard, the Commission on Human Rights (CHR) lauds DepEd in its recent reiteration […]
Statement of CHR Executive Director, Atty Jacqueline Ann de Guia, on the protection of children in schools and the sexual abuse allegations surrounding teachers in Cavite and Camarines Norte

As children learn best in safe environments, the Department of Education (DepEd)’s Child Protection Policy was formulated with the aim of protecting young learners from cruelty, abuse, harm, and other conditions prejudicial to their development carried out by adults, persons in authority, and/or their fellow students. The creation of Child Rights in Education Desk and the Child Protection Unit, as well as the subsequent adoption of the Rights-Based Education Framework for Philippine Basic Education, further strengthen DepEd’s commitment in upholding the broad range of rights of children in education. It is thus concerning how individuals tasked with educating young children have been allegedly involved in actions that are unbecoming of […]
イサベラにおける未成年者強姦殺人容疑に関するCHR報道官ジャクリーン・アン・デ・ギア弁護士の声明
The Commission on Human Rights (CHR) through its regional office in Region II will be conducting a motu propio investigation into the alleged rape-slay of a 10-year-old girl whose body was found on Wednesday, 25 May 2022 in Mabiret River, Purok 4, Balluarte, Santiago City. It is concerning that barely a week has passed since CHR has taken cognizance and investigated a similar incident in Batangas (https://bit.ly/3sZ1JKa). We strongly condemn this heinous crime and all other acts of violence towards children. Crimes perpetrated against the young and defenseless represents a failure to protect the most vulnerable members of society. We urge local law enforcers and barangay community leaders, who are […]
CHR事務局長、ジャクリーン・アン・デ・ギア弁護士は、共和国法第11767号、または孤児認定保護法の成立を歓迎する声明を出した。

Earlier this year, the Commission on Human Rights (CHR) lauded the Senate for approving on the third and final reading Senate Bill 2233 which provides additional rights and welfare to ‘foundlings’ or abandoned children with unknown parents. On 6 May 2022, President Rodrigo Duterte finally signed the bill into law. Republic Act No. 11767, or the Foundling Recognition and Protection Act states that a foundling found in the country or in Philippine embassies, consulates and territories abroad, is presumed a natural-born Filipino citizen regardless of the status or circumstances of the child’s birth. While CHR has previously explained that, as enshrined in Article 15 of the Universal Declaration of Human […]

CHR reminds the government and local government officials of the need […]
Statement of the CHR Center for Gender Equality and Women’s Human Rights – Gender Ombud celebrates law against child marriage; alarmed of BTA members’ plea for veto

The Commission on Human Rights, as the Country’s Gender Ombud, celebrates the passage of Republic Act No. 11596, also known as an Act Prohibiting the Practice of Child Marriage. The passage of the Act is a gender equality and child rights milestone, establishing the Country’s commitment in abolishing traditional and cultural practices and structures that perpetuate discrimination, abuse, and exploitation. Recommendations from several reporting cycles both in the United Nations Committee on the Elimination of Discrimination Against Women (CEDAW) and the UN Committee on the Rights of the Child (CRC), have consistently urged the Philippines to review and amend current laws that allow child marriages. These expert bodies and several […]
Statement of CHR Spokesperson, Atty Jacqueline Ann de Guia, on the brutal killing of a 12-year old girl in Nabua, Camarines Sur

The Commission on Human Rights (CHR) strongly condemns the brutal killing of a 12-year old girl in Nabua, Camarines Sur and is currently investigating the case to shed light on this violent incident. This week, as we commemorate the 12th year anniversary of the passage of the Magna Carta of Women, the persisting culture of violence against women and girls is once again highlighted in the recent slay of the said child-victim. Such transgression is unacceptable and violates the basic human rights and dignity of a girl child. The CHR recognises the commitment of the City Government of Iriga City in delivering justice to the victim and her family. Likewise, […]
ダバオ市の少年拘置所における新型コロナウイルス感染症の発生について、CHR報道官ジャクリーン・アン・デ・ギア弁護士の声明

The Commission on Human Rights (CHR) expresses deep concern for at least 49 youths who tested positive to Covid-19 at the Davao City Children’s Village or Bahay Pagasa, a temporary shelter in Tugbok District for children in conflict with the law (CICL). We recognise the prompt action taken by the local authorities to contain the outbreak and hope for the speedy and full recovery of the patients. It is important to note that measures taken amid a health crisis should not undermine the fundamental rights of detained people, especially children, including their rights to adequate health care, food, water, and sanitation, while also upholding their right against ill-treatment. The risks […]
Statement of CHR Spokesperson, Atty Jacqueline Ann de Guia, in celebration of the International Day against the Use of Child Soldiers 2021

It is appalling that, even up until this day, children are being recruited as soldiers in areas of armed conflict. Today, 12 February 2021, as we celebrate the International Day against the Use of Child Soldiers or Red Hand Day, the Commission on Human Rights (CHR) joins the call for a stronger action in putting the practice of using child soldiers to an end. The trend is a cause for concern as children are continuously victimised for different reasons. Some are forced and abducted, while others are deceived or made to believe that joining an armed group is a chance for a better life. In the field, children in armed […]
