The Commission on Human Rights (CHR) notes the decision of the International Criminal Court (ICC) Appeals Chamber to deny the appeal of the Government of the Philippines meant to suspend the investigation on the alleged crimes against humanity committed in the context of the previous administration’s anti-drug campaign in the country. From the lens of justice, CHR acknowledges the continuation of the investigation as part of the due process meant to uphold the rights of victims, as well as the accused, through a fair and impartial procedure with the end view of exacting truth and, later on, accountability from the perpetrators if and when guilt is established.  As the country’s […]

Statement of the Commission on Human Rights on the authorisation of the International Criminal Court Pre-Trial Chamber to proceed with investigation in the Philippines

The Commission on Human Rights (CHR) notes the recent decision of the International Criminal Court (ICC) Pre-Trial Chamber I authorising the Prosecutor, Karim A.A. Khan KC, to proceed with the investigation of the crimes against humanity allegedly linked with the so-called ‘drug war’ of the Government of the Philippines under former President Rodrigo Roa Duterte. To recall, the deferral of the ICC investigation was due to the request of the Government of the Philippines on 28 November 2021, pursuant to Article 18(2) of the Rome Statute. On 24 June 2022, the ICC Prosecutor requested to resume the investigation into the Philippine case. Following the deferral request, the ICC Pre-Trial Chamber […]

国際刑事裁判所(CHR)事務局長ジャクリーン・アン・デ・ギア弁護士による、大統領が国際刑事裁判所に再加盟しない決定について述べた声明

The Commission on Human Rights (CHR) respects the prerogative of the President in deciding not to rejoin the International Criminal Court (ICC). This move, however, is unfortunate when viewed from the human rights perspective given the calls from both domestic and international fronts seeking truth and accountability for the thousands of deaths allegedly linked to the previous administration’s campaign against illegal drugs. Being part of the ICC would have also been a strong mark of the government’s commitment in ensuring that there will always be a remedy for human rights violations and in protection of present and future generations of Filipinos. Human rights, as well as the pursuit of truth […]

Statement of CHR spokesperson, Atty. Jacqueline Ann de Guia, on the effect of the withdrawal of the Philippines from the International Criminal Court

The Commission on Human Rights continues to view the unilateral withdrawal of the Philippine President from the International Criminal Court (ICC) as a reversal of the country’s commitment to international treaty obligations, particularly in ending impunity, and a step back from the gains the Philippines has achieved in promoting justice and human rights. In the end, it is the Filipino people who is bound to lose when they no longer have the recourse in times when local justice systems fail in protecting them. It is then impunity that wins as a consequence of withdrawal. The task before the Philippine government is to show—beyond words—that it is willing to investigate, prosecute, […]

Statement of the Commission on Human Rights on the President’s order to the police and military to refuse investigation by international bodies

Press Statement | 2 March 2018 We are a nation of laws and we give primacy to the rule of law. As a signatory to various treaties, the challenge for the administration is to demonstrate its commitment and sincerity in fulfilling its treaty obligations and, in the course, show transparency in investigating human rights violations so that perpetrators are brought to justice and for the world to see that there is recourse for victims under our justice system.
