The Commission on Human Rights (CHR) notes the recent decision of the International Criminal Court (ICC) Pre-Trial Chamber I authorising the Prosecutor, Karim A.A. Khan KC, to proceed with the investigation of the crimes against humanity allegedly linked with the so-called ‘drug war’ of the Government of the Philippines under former President Rodrigo Roa Duterte. To recall, the deferral of the ICC investigation was due to the request of the Government of the Philippines on 28 November 2021, pursuant to Article 18(2) of the Rome Statute. The Commission on Human Rights (CHR) notes the decision of the International Criminal Court (ICC) to move the case of the Philippines forward to preliminary investigation. To recall, in 2020, the Office of the Prosecutor at the ICC, led by Fatou Bensouda, reported that there is ‘reasonable basis to believe’ that crimes against humanity—particularly murder, torture, and infliction of serious physical injury and mental harm as other inhumane acts—were committed in the Philippines linked to the government’s campaign against illegal drugs. As the country’s national human rights institution, CHR urges the government to acknowledge and address the observations of the ICC, with regards to its findings, and calls for greater transparency and accountability from the government in the movement towards providing redress for cases of human rights violations. The Commission on Human Rights continues to view the unilateral withdrawal of the Philippine President from the International Criminal Court (ICC) as a reversal of the country’s commitment to international treaty obligations, particularly in ending impunity, and a step back from the gains the Philippines has achieved in promoting justice and human rights.
